TERMS AND CONDITIONS FOR ACADEMY OF ADVANCED BEAUTY LTD

These terms and conditions govern your use of our website and detail any contractual obligations you will be required to accept upon enrolment in any of our courses. Please read the terms in full before you use this Website or enrol on any of our courses. If you do not accept these terms, please do not use this Website. Using the Website implies that you accept these terms. We do occasionally update these terms so please refer back to them in the future.

1.SITE ACCESS

You will be able to access the majority of this Website without having to register any details with us. [However, particular areas of this Website will only be accessible only if you have registered.]

2. USE OF WEBSITE

2.1 You are permitted to use our website for your own purposes and to print and download material from this Website provided that you do not modify any content without our consent. Material on this website must not be republished online or offline without our permission. You may be face legal action if you breach this term.

2.2 The copyright and other intellectual property rights in all material on this Website are owned by us or our licensors and must NOT be reproduced without our prior consent.

2.3 Subject to paragraph 2.1, no part of this Website may be reproduced without our prior written permission.

3. SITE UPTIME

3.1 We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and, other technical issues. Therefore, we will not be liable if this website is unavailable at any time.

3.2 This Website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.

4. VISITOR CONDUCT

4.1 With the exception of personally identifiable information, the use of which is covered under our Privacy Policy, any material you send or post to this Website shall be considered non-proprietary and not confidential. Unless you advise to the contrary we will be free to copy, disclose, distribute, incorporate and otherwise use such material for any and all purposes.

4.2 When using this website you shall not post or send to or from this Website any material:

(a) for which you have not obtained all necessary consents;

7. EXCLUSION OF LIABILITY

7.1 Neither we nor any other party (whether or not involved in producing, maintaining or delivering this Website), shall be liability or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of our website. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss, and whether in tort or contract or otherwise in connection with this Website.

7.2 Nothing in these Terms shall exclude or limit liability for (i) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under the law of the United Kingdom.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it.

8.2 Those works are protected by copyright laws and treaties around the world.  All such rights are reserved. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

8.3 You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

9. COURSE PAYMENT

9.1 Payment for courses can be made via bank transfer, PayPal or iZettle, with the student bearing the cost of the transaction fee, if applied

9.2 Course materials will be released as soon as confirmation of successful receipt of course fees in full has been acknowledged. Our course materials are extensive, but we ask that they are read in full before coming on the practical element of the course. We also ask that any assignments that are sent to the student before the practical session are completed (if required) before attending the on-site course at CB6 2NY.

9.3 As our study materials are available online only, if the student requests a hard copy, a contribution towards print and postage costs of £15 per course manual will be applied

10. REFUND POLICY

10.1 For any courses cancelled after the receipt of course materials, no refund will be given and students will be charged 100% of the course fee.

10.2 In the event of a genuine reason for cancelation (proof of which may be required), a request for transfer to a later course date will be considered at our discretion

10.3 In the unlikely event that your course is cancelled last minute by your tutor due to unforeseen circumstances, you will be offered an alternative date for your course

11. ARRIVING AT THE ON-SITE TRAINING

11.1 Please allow plenty of time to arrive punctually for your course

11.2 If you arrive at your course more than 30 minutes late, without contacting the Academy of Advanced Beauty beforehand, your tutor has the right to refuse you joining the class. We suggest arriving at least 15 minutes before the course

12. DURING THE ON-SITE TRAINING

12.1 During the on-site training, students will be expected to practise their skills on one another. You must inform the Academy of Advanced Beauty up to seven days prior to your course if you do not wish to participate in the practical as a model. Alternative options cannot be arranged with less than seven days’ notice. In the event that you will be attending the on-site training alone, the Academy of Advanced Beauty will provide models for the training session

12.2 Please note that the content of all our courses and manuals is protected by copyright, therefore you may not reproduce, modify, copy or distribute or use for commercial purposes any of the material we provide you. The course material is provided only for students attending our courses and must not be used for further sharing or teaching purposes without express written permission from the Academy of Advanced Beauty

12.3 We do not charge extra for one-on-one tuition

12.4 We require the students to have read the course materials fully, which they will have received prior to the on-site course at CB6 2NY. Failure to do this may constitute in a breach of contract between the learner and the course provider. We retain the right to refuse training to any student who has failed to read the course materials before attending the on-site course. Reading the course materials in full enables the students to get the most out of our course

12.5 Certificates are only given when students have demonstrated full competence and understanding of the subject taught through assessment in the form of theory examination and practical observation

12.6 Please note that during the training day the students are covered by the Academy of Advanced Beauty’s insurance policy

13. COURSE COMPLETION

13.1 Once you have completed a course with Academy of Advanced Beauty, and your certificate has been issued, you will not be entitled to any form of refund or rebate

13.2 Course certificates will only be released upon successful completion of the course and upon full receipt of the course fee. Both of these conditions must be met. Academy of Advanced Beauty is entitled to withhold release of certification in the event of failure to pay course fees in full.

13.3 Due to the significance that insurance partners of Academy of Advanced Beauty attach to certification provided by Academy of Advanced Beauty, certificates may not be rescinded by the Academy of Advanced Beauty at any time, in order to protect the rights of the learner.

14. RELIANCE ON INFORMATION POSTED

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed.  We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

15. OUR SITE CHANGES REGULARLY

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.
